
On Saturday 30 November 2024, CNBC reported that Elon Musk has requested the US court to restrict ChatGPT makers Open Ai from converting into a for-profit enterprise.
The lawyer of Elon Musk, his Ai startup xAi and a former member of Open Ai board Shivon Zilis filed a case against Open Ai on Friday. Elon Musk also requested the court to stop Open Ai from apparently prohibiting its investors from funding competing companies.
Elon Musk and CEO of Open Ai Sam Altman founded the group in 2015. But soon after Elon Musk left. This case against Open Ai indicates the rise in the legal fight between the two parties.
This is not the first time Elon Musk filed a case against Open Ai. Back in March 2024 originally sued Open Ai in San Francisco state court. Several months later Elon Musk refiled a case in Federal court. In Los Angeles Marc Toberoff who is the lawyer of Elon Musk in the federal court said that Open Ai has violated the RICO laws.
Over recent years, Open Ai has witnessed a great rise in their profile. It has become a frontline player in the evolving field of Artificial Intelligence.

Elon Musk claimed that the Open Ai has prohibited their investors from making an investment in their rivals. This would be a disadvantage for his own startup in a field where billions of dollars are at stake.
In the mid of November, Elon Musk also complained that Microsoft and Open Ai both violated antitrust laws. Apparently the maker of ChatGPT asked their investors to invest in their rival companies. It also included Elon Musk’s new startup xAi.
Open Ai was founded as a non-profit enterprise. After that Open Ai has switched to perfect for-profit enterprises. Currently, Open Ai is looking to become a for-profit public benefit corporation. This can attract more investment.
Elon Musk left Open Ai in 2018. He said that he is not comfortable with the profit driven direction that was taken by the company under the leadership of CEO Sam Altman.
This was the reason for which Elon Musk filed a case against Open Ai in US court. He filed the case in March and claimed that Open Ai has been distracted from their actual mission to make the research of Ai available for the common public.
In the reply of Elon Musk, Open Ai said that the filing case of Elon Musk is not because of the genuine problem rather it is due to his personal dissatisfaction related to his decision to leave Open Ai.
